ALL students riding horses at Little Bit Farm must read and sign the following waiver:
WARNING:
Under New Hampshire State Law, an equine activity sponsor, an equine professional,
or any other person engaged in an equine activity, shall not be liable for injury
or the death of a participant resulting from the inherent risks of equine activities.
RSA 508:19 – Liability: Equine Activities.
Waiver of Liability and Hold Harmless Agreement
In consideration for participating in the Little Bit Farm, LLC Horse Back Riding Lesson Program,
1. I hereby RELEASE, WAIVE, DISCHARGE AND AGREE TO HOLD HARMLESS Little Bit Farm, LLC, its Officers or Employees (hereinafter referred to as “RELEASEES”) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the RELEASEES, or otherwise, while participating in such activity, or while in, on or upon the premises of Little Bit Farm, LLC.
2. I am fully aware of the risks and hazards connected with the activity of horse back riding, the risk of which include but are not limited to, injuries, death or property damage from: mounting, riding, dismounting, walking, grooming, feeding, use of horse barn, paddock, trails or horse ring, in any capacity; falling off horse whether horse is bucking, flipping, spooked; or my failure to understand any equine professional’s directions relating to my riding or otherwise use and control, or lack thereof, of my horse or the horse I have been assigned to, or interactions with other horses. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or any loss or damage to property owned by me as a result of being engaged in such an activity, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise.
IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing
Waiver of Liability and Hold Harmless Agreement, understand it and sign it voluntarily
as my own free act and deed, no oral representations, statement or inducements,
apart from the foregoing written agreement have been made; I am at least eighteen
(18) years of age (If minor, parent or person representing himself/herself to
be the lawful Guardian must sign), and I am fully competent. I hereby further
agree that this Waiver of Liability and Hold Harmless Agreement shall be construed
in accordance with the laws of the State of New Hampshire.
Lesson Horse Lease/Half-Lease Agreement
In consideration for participating in the Little Bit Farm, LLC Lesson Horse Lease Program, I hereby agree to pay the sum of $_________ per month to Little Bit Farm to lease/half-lease a lesson horse (any one of four available horses) and acknowledge that this lease entitles me to the following:
1. One weekly Private / Group lesson (total of 4
in each month, to be scheduled in advance). Lessons can be rescheduled, but
one lesson must be taken each week.
2. Up to 2 / 3 practice rides per week (to be scheduled
in advance). I understand these practice rides DO NOT accumulate, and will be
forfeited if I do not show up to ride. However, these practice rides may occasionally
be rescheduled during each week at the discretion of Little Bit Farm by telephoning
in advance, if lesson schedule permits. All practice rides will be on the farm,
i.e., in the round pen or riding ring and circumferential trail. Duration of
practice rides will not exceed 1 hour. I agree to thoroughly cool out horse
after each ride and put him away clean, dry and appropriately blanketed. Little
Bit Farm hosts weekly trail rides. I may participate in these rides (depending
on riding ability) at the discretion of Little Bit Farm and these trail rides
will count as a practice ride or lesson.
3. Use of tack & equipment i.e., saddle, saddle
pad, bridle, protective horse boots, coolers, blankets, horse brushes and vacuum.
This equipment is provided by Little Bit Farm and is in excellent condition
and repair. I agree to clean saddle and bridle used by me each time I finish
riding, and to return equipment to its place and in general, clean up after
each ride (i.e., leave stable as I found it).
4. Horse care: full board (daily feed, stall cleaning,
turn-out), veterinary care, worming and horse shoeing is provided by Little
Bit Farm.
It is further agreed and understood that:
Protective headgear will be worn while riding. I agree to provide my own protective head gear: SEI approved riding helmet and I agree to wear this helmet each time I ride. Riding without protective headgear instantly terminates lease, and lease fee will be forfeited.
Appropriate riding apparel will be worn. I understand that SNEAKERS and Bell Bottom Jeans ARE NOT APPROPRIATE Riding Apparel and I will not wear them while riding. I will wear appropriate footwear, i.e., either paddock boots, tall boots or regular shoes with a low heel.
Sole Riding Privilege. I understand that I have sole riding privilege and will not allow anyone else (family, relative or friend) on the horse during this lease period. Lease will be terminated and lease fee forfeited if I allow anyone else on the horse during lease period.
Sole Owner of Horse. Little Bit Farm is the sole owner of the leased horse and has complete authority regarding care and use of this horse by me. Little Bit Farm has four (4) horses available for lease and will provide one for me each time I ride. I will not remove horse from property at any time (except for guided trail rides with Little Bit Farm personnel).
IN SIGNING THIS LEASE, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing, understand it and sign it voluntarily as my own free act and deed. I am at least eighteen (18) years of age (If minor, parent or person representing himself/herself to be the lawful Guardian must sign), and I am fully competent.
